1. General
Frozberries is an e-commerce platform where you can browse, select, and order products directly through this website. By accessing or using any part of this website, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
If you are under the age of 18, you must obtain consent from a parent or legal guardian before using the website. By proceeding with your visit or purchase, you represent that such consent has been obtained.
2. Compliance with the Terms & Conditions
By registering an account and utilizing the Site to purchase Products, you acknowledge and agree to be bound by these Terms and Conditions. Each order placed constitutes your continued acceptance of the most current version of these terms. We reserve the right to update these Terms and Conditions at any time, and continued use of the Site after such changes constitutes acceptance of the modified terms.
3. Registration
Before placing an order for Products through the Site, you must complete the customer registration process. Any personal information that you provide will be held and used by us in accordance with our Privacy Policy.
You may update, edit, or terminate your account at any time through the Site. Your account is non-transferable, and you may not have more than one active account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
If you use a workplace email address for your account or to access the Site, you are solely responsible for ensuring that you comply with the rules, policies, or protocols that apply to the use of your email address and your workplace facilities.
4. Placing an Order for Products
To order Products, select and submit your order through the Site in accordance with these Terms and Conditions. Any order you place through the Site for a Product is an offer by you to purchase the Product for the price notified (including delivery, other charges, and taxes) at the time you place the order.
We may ask you to provide additional details or require you to confirm your details to process any orders placed through the Site. You agree to provide us with current, complete, and accurate details when asked to do so by the Site. We may call you to process your incomplete Order if all details are provided.
5. Payment
We currently accept all major credit cards and payment methods approved by ANZ eGate. By completing your purchase, you authorize the processing of payment through this secure gateway. For your protection, all payment processing and bank details are managed exclusively by ANZ. Frozberries does not store or hold any credit card information on our servers.
All prices displayed on the Site are in Australian dollars (AUD) and include GST where applicable. We reserve the right to correct pricing errors on our Site or on pending orders.
Payment must be received in full before your order is processed for delivery or collection.
6. Product Availability
We understand that items you have ordered may become unavailable by the time your order is being packed. In such cases, we will make every effort to contact you via email or phone to offer alternative options or substitutes.
In the event that an item becomes unavailable after your order is placed, we will notify you accordingly. If you do not wish to receive a substitute product, the unavailable item will be removed from your order, and a refund for that portion of your purchase will be initiated immediately to your original payment method.
To ensure we can communicate with you effectively, please leave clear directions and contact preferences in the comments section during checkout.
7. Product Quantities
We try to meet the needs of our customers however in events of stock constraints, we may not be able to fulfill orders for larger quantities of specific items. If you plan to place an order for large quantities of specific items, please contact us beforehand to confirm availability and avoid disappointment.
8.Frozen and Perishable Items
We use refrigerated trucks for transportation and proper packaging to protect sensitive products during transit. But, we cannot offer guarantees for perishable and frozen products left unattended for extended periods of time if you are not available to collect them.
Please ensure you are available to collect these items at the time of delivery or arrange for someone to do so on your behalf. We recommend that frozen items be transferred to appropriate storage immediately upon receipt.
If perishable items are damaged, spoiled, or defrosted upon delivery due to our handling or transportation, please contact us immediately for a refund or replacement.
9.Health and Accessibility Accommodations
We are committed to making our products accessible to all customers. If you require special delivery arrangements due to health conditions, mobility limitations, or other accessibility needs, please notify us at the time of purchase.
You may include specific requests such as contactless delivery, doorstep assistance, or special handling instructions in the order comments section, or contact our customer service team directly. We will make reasonable efforts to accommodate your needs while maintaining service quality and safety standards.
10.Returns and Redunds
Quality Issues : Contact us within 24 hours of delivery if you receive damaged, defective, or spoiled products.
This also applies to incorrect items or poor quality. Send photographic evidence of the issue.
Change of Mind : Food safety regulations prevent returns for change of mind. Perishable items are final sale once delivered or collected.
Valid claims receive one of these options:
- A full refund to the original payment method
- A free replacement product
- Store credit
Refund Processing : We process approved refunds within 5 to 10 business days. You receive a confirmation email when the refund starts.
Nothing in these Terms and Conditions excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law or any other applicable law that cannot be excluded, restricted, or modified by agreement.
11.Our Online Store
We are proud to offer a wide range of products on our online website and factory pick-up service. Products are added regularly, and you can easily browse using the Product menu on the website or by using the search bar at the top of the page.
Factory pick-up is available by appointment only. To schedule a pick-up, please contact us at least 24 hours in advance.
12. Acceptance and Rejection of an Order
We reserve the right to accept or reject any order placed for any reason, including but not limited to:
- Unavailability of the requested product
- Errors in the price or product description on the Site
- Errors in your order
- Suspected fraudulent activity
- Breach of these Terms and Conditions
13. Minimum and Maximum Amounts in Each Order
To place an order, the following minimum order values and delivery charges apply based on your delivery location:

Delivery and handling fees are calculated at checkout and are subject to change based on location.
We reserve the right to adjust minimum order values, delivery fees, or handling fees with at least 7 days’ notice, communicated via email or website announcement.
14. Collection of Products
You agree to comply with all collection requirements and conditions notified at the time of ordering through the Site, including providing photographic identification, a signature upon collection, and presentation of the card used for payment, if someone other than you collects your order, they may be required to provide proof of identity, age, and the relevant payment card, and failure to provide appropriate identification or the relevant card may result in non-collection of the Products. We reserve the right to cancel your order if we suspect illegal transactions or a breach of these Terms, and we will contact you to confirm payment and information details where required.
15. Risk and Title
The risk of loss or damage to the Products passes to you upon delivery to your nominated address or upon collection from Frozberries premises, and the title or ownership of the Products passes to you only after full payment has been received and delivery or collection of the Products has occurred.
16. Cancellation of an Order
Frozberries may cancel any order, including an order that has already been accepted, at any time without liability to you if the Products are unavailable, if there is a pricing or product description error on the Site, if you have breached these Terms and Conditions, or if we suspect fraudulent activity, and if we cancel your order we will provide you with reasonable notice and you will not be charged for the cancelled order, and if any payment has been taken the full payment amount including the packing fee and other charges will be refunded to your original payment method. You may cancel an order before it has been packed and dispatched by contacting us, but if you cancel an accepted order after it has been packed or dispatched we may charge you a cancellation fee of $20, plus the costs incurred by Frozberries as a result of the cancellation, and the full price of any perishable Products that have been packed, and cancellation fees will be deducted from any refund owed or charged separately.
17. Fees and Charges
We may charge you the purchase price of each ordered Product, the packing fee, delivery fees, the cancellation fee if applicable, and any other applicable fees and charges, and all fees and charges include GST where applicable and are in Australian dollars (AUD), and the purchase price of each Product is shown on the product listing on the Site at the time you place your order.
18. Delivery
We aim to deliver your order within 0-4 working days for Sydney and within 7-14 working days for areas outside Sydney including Wollongong, Central Coast, Newcastle, and Port Macquarie, and these are estimated delivery timeframes that may be affected by unforeseen circumstances such as weather, public holidays, logistical problems, or high demand periods, and we will notify you if significant delays are expected, and you must provide a complete and accurate delivery address as we are not responsible for failed deliveries due to incorrect or incomplete address information, and if delivery cannot be completed because no one is available to receive the order, we will attempt to contact you to arrange re-delivery and additional delivery fees may apply for re-delivery attempts.
19. Limitation of Liability
To the maximum extent permitted by law, Frozberries’ total liability to you for any loss or damage arising out of or in connection with these Terms and Conditions or your use of the Site is limited to resupplying the Products or refunding the purchase price paid for the Products, and we are not liable for any indirect, incidental, special, or consequential damages including, but not limited to, loss of profits, loss of data, or loss of business opportunity.
20. Product Descriptions and Information
We make every effort to ensure that product descriptions, images, and prices on the Site are accurate, but we do not warrant that product descriptions, images, pricing, or other content on the Site are accurate, complete, reliable, current, or error-free, and if a product certain attribute is not as described, your action could be to research on any other reliable sources or to simply contact us, however , if product is completely different and wrong, sole remedy is to return it in accordance with our Returns and Refunds policy.
21. Privacy and Data Protection
Your privacy is important to us, and we collect, use, and disclose your personal information in accordance with our policy, and by using the Site and placing orders, you consent to the collection, use, and disclosure of your personal information as described in our Privacy Policy and as necessary to fulfill your orders.
22. Intellectual Property
All content on the Site, including but not limited to text, graphics, logos, images, and software, is the property of Frozberries or its content suppliers and is protected by Australian and international copyright and intellectual property laws, and you may not reproduce, distribute, modify, or create derivative works from any content on the Site without our express written permission.
23. Third-Party Links
The Site may contain links to third-party websites or services that are not owned or controlled by Frozberries, and we have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.
24. Dispute Resolution
If you have a complaint or dispute regarding our products or services, please contact us with details of your concern, and we will try our best to resolve the issue promptly and fairly, and if we cannot resolve the dispute through direct communication, you may refer the matter to an independent dispute resolution service or the relevant consumer protection authority of the state.
25. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of New South Wales, Australia, and you irrevocably and unconditionally submit to the exclusive jurisdiction of the courts operating in New South Wales.
26. Severability
If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of law, the remaining provisions will continue in full force and effect.
27. Waiver
Our failure to enforce any right or provision of these Terms and Conditions will not be deemed a waiver of such right or provision.
28. Entire Agreement
These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and Frozberries regarding the use of the Site and the purchase of Products.
